1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the VisaNow website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service constitutes acceptance of any updates to these Terms.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

• You have the legal capacity to enter into a binding agreement.
• You are not barred from using the Service under any applicable law.
• You will provide accurate and complete information when applying.

If you are submitting an application on behalf of another person (such as a minor or family member), you represent that you have the legal authority to do so.

3. Service Description

VisaNow provides a digital platform that assists travelers in preparing and submitting visa, eTA, arrival-card, and similar travel-document applications to the relevant authorities. We act as an intermediary; the final decision to grant or deny any travel document is made solely by the issuing authority.

• Reviewing your submitted information for completeness and consistency.
• Adapting your documents to the technical standards required by the authority.
• Submitting your application to the relevant authority on your behalf.
• Tracking your application status and notifying you of updates.

4. Fees and Payment

Our fees are displayed clearly before checkout and include all service charges. Government and processing fees, where applicable, are itemized separately. All fees are non-refundable except as set out in our <strong>Refund Policy</strong> below.

• Service fee: the amount charged by VisaNow for processing your application.
• Government fee: the fee charged by the issuing authority, passed through at cost.
• Currency conversion: where applicable, processed by our payment provider at prevailing exchange rates.
• Taxes: shown at checkout where applicable (e.g., VAT).

5. Refund Policy

• Before submission to the authority: full refund of the service fee; government fees refunded net of any non-recoverable charges.
• After submission but before decision: service fee non-refundable; government fees refunded only if the authority refunds them.
• After the authority has decided: no refund of any fees, regardless of outcome.
• Refunds for ineligibility: if we determine at intake that you are ineligible (e.g., passport validity), we refund the service fee in full.
• Processing time: refunds are typically issued within 5–10 business days.

6. Account Responsibilities

When you create an account with us, you agree to: provide accurate, current, and complete information; maintain the security of your password and account; notify us immediately of any unauthorized use; and accept responsibility for all activities under your account.

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading, or if you breach these Terms.

7. Acceptable Use

• Do not use the Service for any unlawful purpose or in violation of any applicable laws.
• Do not submit fraudulent, altered, or misleading documents or information.
• Do not attempt to gain unauthorized access to any portion of the Service.
• Do not interfere with or disrupt the Service or its servers.
• Do not use any robot, spider, or automated means to access the Service.
• Do not resell or commercialize the Service without our written permission.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of VisaNow and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

• You retain ownership of the personal documents and information you submit.
• You grant us a limited license to use, store, and transmit your submissions solely for the purpose of providing the Service.
• Feedback you provide may be used by us without restriction or compensation.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, VisaNow disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
• We do not warrant the accuracy of any information provided by third parties, including issuing authorities.
• We do not guarantee that any visa or travel document will be approved.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall VisaNow, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless VisaNow and its affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of your breach of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.

Provisions of these Terms which by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitations of liability.

13. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also revise these Terms from time to time; the most current version will always be posted on this page.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree, you must stop using the Service.

Material changes will be communicated by email where you have provided a valid address and consented to such communications.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the operating entity of VisaNow, without regard to its conflict-of-law principles.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved by negotiation, it shall be submitted to binding arbitration in accordance with applicable law.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary so that the remaining provisions remain in full force and effect.
